Terms and Conditions of hiring a MotoReggi scooter
By hiring a scooter, the driver(s) acknowledges having read and accepted the terms and conditions detailed in this document.
By hiring, the driver/s agree to respect at all times the traffic regulations in force and be responsible for any penalties that may arise from the misuse or breach of the rules and for the duration of this contract.
The damages caused by reckless and/or negligent driving, as well as driving under the influence of alcohol or drugs are NOT included. Any of the above mentioned reasons, exempts the company from any responsibility for damages caused with our scooter.
The clauses of the rental contract can only be modified by express written agreement signed by both parties. The company reserves the right to cancel reservations at its sole discretion upon prior notice to the customer as well as the right of admission.
In case of breach of any of the general conditions set forth in this contract, Motos Reggi may terminate this contract at any time, thus requiring the immediate return of the vehicle to our facilities in Ciutadella and will not proceed to any refund of the amount paid.
ARTICLE 1 - RENTAL REQUIREMENTS
Minimum experience 3 years of license, as well as experience in the driving of the same ones. If at the time of delivery, the Reggi operator perceives that the client does not know how to drive the motorcycle, the motorcycle will not be delivered and the payment made will not be refunded.
- To be over 21 years old
- Valid passport or ID card.
- Original and valid driver's license.
o 125cc (A1 or B with 3 years of seniority).
o For driving licenses outside the EU or without agreement with Spain, it will be necessary to present the International Driving License in addition to the original. (Ask at your embassy before booking).
- Reservation voucher
- Minimum three years of experience.
No photos, photocopies or reports and/or any other document other than the original driver's license will be accepted. In case the Client does not meet the above mentioned conditions, the vehicle will not be delivered and the amount paid will not be refunded.
ARTICLE 2 - COLLECTION AND RETURN OF THE VEHICLE
The Client receives the vehicle in perfect working condition and with accessories (keys, helmets and original documentation). He/she must check it with the person in charge of delivering the motorcycle; acknowledging to be informed of the type of fuel that the vehicle requires; and committing to return the vehicle in the same conditions in which he/she receives it, the customer has one hour after the date of contracting to detect any anomaly of the motorcycle.
The customer agrees to return the vehicle to Motos Reggi on the date and time scheduled and in the place agreed in the rental contract, and may vary as long as the new location is not far from 10 kilometers or more and the customer notifies at least 24 hours in advance.
If for reasons beyond our Company's control, the Client does not pick up the vehicle at the time agreed in the reservation or contract, we will not extend the contract nor will we pay for the hours or days not used.
The delivery of the vehicle will be made at the time requested by the Client in the reservation form. In case the Client wants to pick up the vehicle before the reserved time, he/she will have to pay the corresponding amount.
The company reserves the right to refuse to advance the reservation if there is no availability. The time of return previously requested by the Client must be respected WITHOUT EXCEPTIONS. In the case of not returning the motorcycle at the agreed time, Motos Reggi will grant 30 minutes of courtesy. After this time the Client will be charged an extra day. The contract will only be terminated when the Client is present at the agreed meeting point, where he/she must return the vehicle and its keys,
helmets and documentation.
ARTICLE 3 - FINANCIAL REQUIREMENTS
In addition to the price of the reservation, if so deemed by the operator who makes the contract, the rental of a motorcycle will require a deposit or deposit. All our rentals include basic third party insurance, at no additional charge to the rental.
The deposits to be paid are:
- Kymco Agility city 125 - 150€.
- Symphony SR 125 - 150€.
In no case the deposit can be used for an extension of the rental. The deposit payment must be made by credit/debit card or cash and will be returned in the same way to the subscriber (In the event that this has been paid by card and the rental period is longer than 28 days can not be returned by credit card payment. The costs of the bank transfer for its return shall be borne by the Customer). This amount does not cover the total amount of the alleged damage, assuming that the damage to the vehicle exceeds the amount of the deposit must be paid by the Customer. When the Client returns the vehicle together with the keys and the Company terminates the contract, the deposit will be refunded.
ARTICLE 4 - INCIDENTS AND THEFT
In the event of an accident or theft, the client has the obligation to contact the Police and make the pertinent report of the theft within 24 hours after the incident. Likewise, you must notify Motos Reggi of the theft by telephone at 680 91 68 54 and send a copy of the complaint to info@motosreggi.com.
In the event of an accident with another vehicle, the Client must submit to Motos Reggi within 48 hours after the incident, the friendly report, completed by both or the Civil Guard report.
In the event of a total loss of the vehicle, with the driver being responsible for whatever the reason for the accident, the company reserves the right to invoice/charge the customer, at least 80% of the market value of the motorcycle at the time of the accident since they are brand new vehicles and it notifies it through these conditions.
In case of theft, you must present the police report and the keys of the vehicle.
In the event that, due to a defect, the vehicle suffers a breakdown and not an accident, Motos Reggi will replace the vehicle as soon as possible, we have 24hrs road service. If it is not possible to replace the vehicle, Motos Reggi will refund the amount corresponding to the days not enjoyed of the contracted rate and will bring you to your place of accommodation.
The Client expressly acknowledges and accepts what is stated in the previous paragraph and waives the right to any compensation if necessary.
The Driver/Client is responsible for the vehicle and the damages caused during the rental unless the Rental Company obtains the acceptance of total or partial responsibility from a third party.
In case of accident, the vehicle will not be replaced, the contract will be terminated and the money will not be refunded for the remaining days of the rental.
The damages that the client can generate will be subject to valuation of the company and later budget on the part of the Lessor. This implies that the deposit/security deposit cannot be returned until the value of the repair is certified with a provisional estimate.
ARTICLE 5 - FUEL
Full - Empty Rate: Motos Reggi will deliver the motorcycle to the Driver with a full tank of fuel. The Client must return the motorcycle as he/she sees fit, being aware that no amount will be reimbursed for fuel.
FUEL FEE according to model:
- 125cc - Fuel: 15€.
All our motorcycles use 95 Lead Free gasoline. If there is any error in the refueling and as a consequence the motorcycle suffers any damage, the repair will be paid entirely by the Client.
ARTICLE 6 - MAINTENANCE
The Customer may not repair the vehicle without prior written authorization from the company. The maintenance and lubrication of the vehicle are included in our rates (punctures and / or tire changes resulting from misuse of the vehicle are not included).
Mechanical wear and tear due to reasonable and normal use of the vehicle is assumed by Motos Reggi. It is the Client's obligation to stop the Vehicle when any anomaly is detected in the operation of the Vehicle. The Client must contact Motos Reggi at 680 91 68 54. In case of damage to the vehicle, as well as its accessories and complements and/or theft of the same, the Client will be charged for the following concepts and amounts:

Baulette: 75€.
Exhaust: 275.51€.
Exhaust side trim: 80€ 80

ARTICLE 7 - ROADSIDE ASSISTANCE
The Roadside Assistance Service is included in the rate if the damage is caused by the motorcycle itself, in case of a negligent accident or in case the vehicle is stopped by the authorities, the cost of the assistance will be 100€ in the case of motorcycles. It is strictly forbidden to park the vehicle on roads, paths and passageways where the vehicle could be damaged or hinder traffic.
ARTICLE 8 - RULES FOR THE USE OF MOTORCYCLES
The Client undertakes to use and drive the vehicle in accordance with the basic rules of driving, circulation and in accordance with the specifications of use of the type of vehicle and with the greatest possible attention, in Motos Reggi we take care of our fleet. When parking the motorcycle, you must put the stand. Under no circumstances park the motorcycle in a way that does not guarantee its stability.
The Client is strictly forbidden to take the vehicle rented from Motos Reggi out of Menorca. Only the person or persons identified and accepted by Motos Reggi in the rental contract are authorized to drive the vehicle, as long as they have a minimum experience of 3 years and are holders and in possession of a valid and in force driving license.
The Client agrees to park it in a safe and properly parked place when not in use. The Customer is forbidden to assign, rent, mortgage, pledge, sell or in any way pledge the vehicle. It is forbidden to vary any technical characteristics of the vehicle or to make any type of modification to its exterior and/or interior appearance (unless authorized in writing by Motos Reggi).
The vehicle may not be transported on board any type of boat, truck or means of transport (unless expressly authorized in writing by the Lessor). In the event of a fine, the Client shall be responsible and shall pay the fine as soon as possible. In the event that the Client has the vehicle removed, the charge for collecting the vehicle from the municipal depot shall be as indicated in the corresponding invoice issued by the local administration.
No refund will be made if the vehicle is returned prior to the expiration date of the contract.
ARTICLE 9 -CANCELLATIONS AND REFUNDS OF THE CONTRACT.
In case the Client wants to cancel the reservation, he/she should contact Motos Reggi, we know that each case deserves our attention.
Cancellation rules and policies: For a full refund of the reservation, the client must give at least 5 days notice prior to the date and time of delivery of the motorcycle. In the case of being within the deadline, we will proceed to the total or proportional refund of the money previously paid by the customer. The refund, if applicable, will be made in the same way in which the reservation was paid. In the event that the cancellation is made 4 or 3 days in advance, 100% of the amount will not be refunded as follows:
5 Days - 100%.
4 days - 80%.
3 Days - 60%.
2 Days - 0%
1 Day - 0%
ARTICLE 10 - LIABILITY DISCLAIMER
Motos Reggi will not be responsible for rentals that are rejected due to lack of documentation and/or necessary requirements for driving. The impossibility to provide the Service or allow access for any reason beyond Motos Reggi's control.
ARTICLE 11 – CLAIMS
In case the user wishes to make a complaint to Reggicenta SC, he/she can send a letter to our headquarters at Calle d'Osca, 5 Baixos. CP 07760 Ciudadela de Menorca, Balearic Islands, Spain or request our complaints book.
ARTICLE 12 - APPLICABLE LAW AND JURISDICTION
These General Conditions shall be governed by Spanish Law, which shall be applicable in all matters not provided for in these General Conditions regarding interpretation, validity and execution. The parties expressly submit to the courts and tribunals of Ciutadella de Menorca to settle any dispute that may arise in the interpretation and/or execution of these General Terms and Conditions.
ARTICLE 13 - DATA PROTECTION CONDITIONS
By signing and/or subscribing with Reggicenta SC the client accepts the general conditions described in this document and accepts having been informed that the personal data provided will be incorporated into the file "Clients" of our company, duly registered in the General Register of the Spanish Agency for Data Protection, which complies with the security measures stipulated in the RD 1720/2007 of December 21, and whose purpose is the management of the company's customers, processing their billing and sending commercial information about our products and services.
